ASSUMPTION OF RISK, RELEASE OF LIABILITY AND INDEMNIFICATION AGREEMENT

THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS

As a guest with a pet staying at Beaver Run Resort, I acknowledge and understand that there are risks associated with having a pet residing with me at a hotel. These risks include, but are not limited to, injuries suffered by the pet while a guest in the hotel, whether attended to or left alone in the hotel room, and physical injuries or death suffered by other guests by actions of the pet. In consideration of allowing the pet to stay in the hotel, I hereby agree to ASSUME ALL RISKS associated with the pet’s presence on the premises of the hotel.

Additionally, I agree to HOLD HARMELESS, RELEASE, DEFEND, AND INDEMNIFY, BEAVER RUN RESORT, BEAVER RUN HOMEOWNERS ASSOCIATION, AND BRIDGE HOSPITALITY, and all their respective insurance carriers, agents, employees, representatives, assignees, officers, directors, and shareholders (each hereinafter a “RELEASED PARTY”) FOR ANY AND ALL LIABILITY and/or claims for injury or death to persons or damage to property arising from the pet’s stay at the hotel, including those claims based on any RELEASED PARTY’S alleged or actual negligence or breach of any implied warranty. I agree to take full responsibility for any injury, loss, or death to the pet, the hotel, myself or any guests, employees or other persons on the hotel premises, which arise in whole or in part out of my pet’s presence on the premises. By signing this release, I agree not to sue any released party and agree I am releasing any right to make a claim or file a lawsuit against any released party.

I further agree to defend and indemnify each released party for any and all claims that I or a third party may make arising from the pet’s presence on the hotel premises. I agree to pay all costs and attorney’s fees incurred by any released party in defending a claim or suite brought as a result of the pet’s presence on the premises.

I agree that any claims arising from the pet’s presence on the hotel premises shall be governed by Colorado law and exclusive jurisdiction of any claim shall be in the district court for Summit County or in the Federal court for the State Of Colorado.

By signing this agreement I represent that I am at least 18 years of age.

I agree to pay a pet deposit as required by the hotel and further agree to pay all costs for any damage to person or property that the pet may cause as a result of being on the premises.

This release shall be binding to the fullest extent permitted by law. If any part of this release is deemed to be unenforceable, the remaining terms shall be an enforceable contract between the parties. This release shall be binding upon the assignees, subrogors, distributors, heirs, next of kin, executors and personal representatives of the undersigned.

I have carefully read the foregoing liability release, understand its contents, and am aware that I am releasing certain legal rights that I otherwise may have.

The pet is up to date with all required vaccinations

I will have no more than two dogs staying in the room

I agree to pay $40 per day for the 1^st pet and $20 per day for a second.

My dog is not under 1 year of age and not over 50lbs

My dog will not be left in the room unattended

I understand that housekeeping will not service the room while the dog is present

I will pick up and dispose of any pet waste with the provided bags

I will put the provided tag on my dog’s collar

I will hang the “dog in room” sign on the door when our pet is in the room

I will keep my pet out of restricted areas: restaurants, lounges, pools, and spa

I understand that in the event a barking dog is found in the room unattended, resulting in guest complaints, security can take the dog out of the room. A fee of $20 per hour will be assessed for time that security is with the pet.

I can be reached at ___________________________ (cell phone) in the event that there is a problem with my pet.

I will inspect the room and report any existing stains, damage, etc, to avoid being charged for pre-existing issues upon check out. I will report them to the manager/supervisor on duty who can be reached through the hotel operator (dial “0”).

I will dial “0” to let the front office know that we are checking out. After the room inspection, the pet deposit will be refunded as long as no extra cleaning is required.
